Why did the House of Lords become the Supreme Court?
The House of Lords did not become the UK Supreme Court, but its judicial functions were transferred to the new Supreme Court in 2009. Here's why this change happened:
Separation of Powers: The House of Lords, as the highest court, combined judicial, legislative, and executive roles, with Law Lords (senior judges) also acting as legislators. This blurred the separation of powers, a key principle in modern democracies. The Constitutional Reform Act 2005 aimed to create a clearer distinction by establishing an independent judiciary.
Judicial Independence: Moving the appellate judicial functions to a separate Supreme Court ensured the judiciary was visibly independent from the legislature and government, aligning with European Convention on Human Rights standards and public expectations for impartiality.
Modernization: The House of Lords' judicial role was seen as outdated. A dedicated Supreme Court provided a modern, transparent institution focused solely on judicial matters, with its own building and administration, opened in October 2009.
Practical Considerations: The new court allowed for better facilities and public access, moving from the cramped conditions in the House of Lords to a purpose-built Supreme Court building in Middlesex Guildhall.
The Law Lords became the first Justices of the Supreme Court, and the House of Lords retained its legislative functions but ceased to serve as a court. This reform strengthened the UK’s constitutional framework while preserving the judicial expertise of the former system.
